This Explicit Consent Form has been prepared, within the scope of Law No. 6698 on the Protection of Personal Data (the “Law”), for the purpose of informing users of the MarineHero platform operated by the data controller PERA Nautica Denizcilik A.Ş. (“PERA Nautica”) and obtaining their consent solely in respect of the processing activities that require explicit consent.

The processing activities set out below are carried out within the scope explained in the Privacy Notice on the Protection of Personal Data (Aydınlatma Metni). By checking the relevant boxes, you declare that you have read the Privacy Notice and that you give your explicit consent to the matters below. These consents are not mandatory, and even if you do not provide them, you may continue to benefit from the core functions of the Application that do not require explicit consent (consent-based features such as location-based matching may not be available in such case).

This English text is a courtesy translation. In case of any discrepancy, the Turkish version (“Açık Rıza Metni”) shall prevail.

Important: The carrying out of payment and financial transactions does not rely on explicit consent. Such processing is carried out without seeking explicit consent, based on the legal grounds set out in Article 5/2 of the Law (performance of a contract, legal obligation, legitimate interest); accordingly, no explicit consent is given or withdrawn in respect of such processing. The consents below are limited solely to the matters you have checked.

1. PROCESSING OF LOCATION DATA

☐ I give my explicit consent to the processing of my location (GPS) data obtained from my device or through the system, for the purposes of locating nearby Service Providers / Customers, correctly matching service requests, and carrying out real-time tracking during the provision of the service.

2. TRANSFER OF PERSONAL DATA ABROAD

☐ Because MarineHero’s technical infrastructure is operated through service providers whose servers are located abroad (e.g. Cloudflare R2 — file/media storage, Google Cloud — database infrastructure, Expo — push notifications, map services), I give my explicit consent to the transfer of my personal data abroad within the scope of Article 9 of the Law.

3. SENDING OF COMMERCIAL ELECTRONIC MESSAGES (Optional)

☐ I give my explicit consent to the sending of commercial electronic messages to me via e-mail, SMS and push notifications, for the purpose of informing me about campaigns, announcements, promotions and service-related developments.

4. STORAGE OF CARD INFORMATION / SAVED CARD (Optional)

☐ I give my explicit consent to the storage of my card information in tokenized (masked) form with the authorized payment institution, for the purpose of providing convenience in recurring payments. This consent is optional, and even if I do not provide it, I may continue to receive services by making payments.

You may withdraw your explicit consent at any time through the application channels specified in the Privacy Notice or via the Application settings. The withdrawal of consent does not affect the lawfulness of the processing carried out up to the moment of withdrawal.
